Welcome to Red's Best and our Terms of Use and Conditions of Purchase ("Terms"). Please read these Terms carefully before using our website, mobile applications, or services, or placing an order for seafood or related products.
By accessing or using any services provided by WildFish LLC dba Red's Best and its affiliates ("Red's Best," "we," "us," or "our"), including our websites, mobile applications, subscriptions, and related services (collectively, the "Services"), you agree to be bound by these Terms and all policies referenced herein. If you do not agree to these Terms, you may not use the Services.
Important: These Terms include a binding arbitration provision and waiver of class actions in Section 15 that affects your legal rights.
1. Privacy Policy
Please review our Privacy Policy for information about how we collect, use, and disclose information about you.
2. Eligibility
You must be at least 18 years old and reside in the United States to use the Services or place an order. By using the Services, you represent and warrant that:
- You are at least 18 years old;
- You have the legal authority to enter into these Terms;
- You have not previously been suspended or removed from the Services; and
- All information you provide is accurate and current.
3. Accounts and Communications
To access certain features of the Services, you may be required to create an account. You agree to:
- Provide accurate and complete information;
- Maintain the security of your account credentials;
- Promptly update your information as necessary; and
- Notify us immediately of any unauthorized use of your account.
By creating an account, you consent to receive electronic communications from Red's Best, including transactional emails, shipping notifications, account updates, marketing emails, and promotional offers. You may opt out of marketing emails at any time using the unsubscribe link provided in those communications.
4. Products and Orders
A. Seafood Products
Red's Best offers frozen seafood and related food products for purchase through the Services ("Products"). Products may include wild-caught seafood, shellfish, prepared seafood products, meal kits, specialty items, and subscription boxes.
Because seafood availability is seasonal and dependent on harvest conditions, weather, fisheries regulations, and supplier inventory, certain Products may be unavailable or substituted without prior notice.
We reserve the right to limit quantities or discontinue Products at any time.
B. Subscription Services
Red's Best may offer recurring seafood subscription plans ("Subscriptions"). Subscription details, pricing, billing frequency, and included Products will be disclosed at the time of purchase.
By enrolling in a Subscription, you authorize Red's Best to automatically charge your payment method on a recurring basis until canceled.
You may manage, pause, skip, or cancel your Subscription by contacting Red's Best prior to the billing cutoff date. Changes made after an order has been processed may not take effect until the following shipment cycle.
C. Pricing and Billing
Prices are listed in U.S. Dollars and are subject to change without notice.
You authorize Red's Best and its payment processors to charge your selected payment method for all purchases, subscriptions, taxes, shipping charges, and applicable fees.
If payment cannot be processed, we may suspend or cancel your order or Subscription.
D. Promotions and Gift Cards
Promotional offers, discount codes, referral credits, and gift cards may be subject to additional terms and conditions.
Gift cards:
- Are not redeemable for cash except where required by law;
- May not be resold;
- May not be replaced if lost or stolen; and
- May be excluded from certain promotions.
5. Shipping and Delivery
Red's Best ships frozen seafood within eligible regions of the United States using insulated packaging and dry ice or gel packs designed to maintain safe temperatures during transit.
Delivery dates are estimates only and are not guaranteed unless expressly stated.
You are responsible for providing an accurate shipping address and ensuring someone is available to promptly retrieve and refrigerate or freeze delivered Products.
We are not responsible for delays or losses caused by:
- Incorrect addresses;
- Weather events;
- Carrier disruptions;
- Failed delivery attempts;
- Business addresses that are closed at delivery; or
- Circumstances outside our reasonable control.
6. Product Storage and Food Safety
Seafood products are perishable and must be handled properly.
Upon delivery, Products should be promptly refrigerated or frozen. You are responsible for inspecting all Products upon arrival and following all storage, thawing, preparation, and cooking instructions.
Red's Best is not responsible for damage or spoilage resulting from improper handling or storage after delivery.
Consumers with seafood allergies should exercise caution. Product processing facilities may handle fish, shellfish, and other allergens.
7. Returns and Refunds
Due to the perishable nature of seafood products, Red's Best generally does not accept returns.
If your order arrives damaged, spoiled, incomplete, or materially incorrect, you must contact customer support within seven (7) days of delivery. We may request photographs or other documentation to evaluate your claim.
At our discretion, we may provide:
- A replacement shipment;
- Store credit; or
- A partial or full refund.
Refunds are not guaranteed for issues resulting from:
- Incorrect shipping information;
- Failure to retrieve deliveries promptly;
- Improper storage after delivery; or
- Customer preference or taste.
8. Intellectual Property
All content on the Services, including logos, trademarks, graphics, product descriptions, photography, videos, software, and text, is owned by Red's Best or its licensors and protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or commercially exploit any content without prior written permission.
9. Prohibited Conduct
You agree not to:
- Use the Services for unlawful purposes;
- Interfere with the operation or security of the Services;
- Attempt unauthorized access to accounts or systems;
- Resell Products without authorization; or
- Use automated systems to access the Services without our permission.
10. Third-Party Services
The Services may contain links to third-party websites or services. Red's Best is not responsible for the content, policies, or practices of third parties.
11. Disclaimer of Warranties
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED'S BEST DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED'S BEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO RED'S BEST FOR THE APPLICABLE ORDER GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Red's Best and its officers, employees, affiliates, partners, and agents from any claims, damages, liabilities, and expenses arising from your violation of these Terms or misuse of the Services.
14. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
15. Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY.
You and Red's Best agree that any dispute arising out of or relating to these Terms, the Services, or Products will be resolved through binding arbitration on an individual basis and not in court.
You waive any right to participate in class actions, class arbitrations, or representative proceedings.
Either party may bring qualifying claims in small claims court.
16. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Services with a revised "Last Updated" date.
Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
